Car Accidents

The frequency with which automobile accidents occur has increased over the years. In 2016, there were over 395,000 traffic accidents in Florida – up over 100,000 accidents per year since 2012. With an increase in annual accidents, Florida has also seen an increase in the number of people injured in car accidents. In fact, over 250,000 people were injured in Florida accidents in 2016.

With the rise in automobile accident injuries each year, the compensation insurance companies willingly pay to the injured has decreased. Insurance companies hire lawyers to defend cases even when their insured driver is clearly at fault. They fight you over your medical bills, lost wages, and the property damage to your vehicle. And to add insult to injury, they do this while you are attempting to recover from the wrongful injury you sustained due to the negligence of their driver.

At Caminez & Yeary we represent victims of car accidents ranging from the soft-tissue injuries that develop in the days and weeks following the accident to the catastrophic injuries including paralysis or death. We stand up for you and fight the insurance company to make sure you get your medical bills paid, lost wages reimbursed, and that you are compensated for the pain, suffering, and inconvenience you have wrongfully endured due to the careless actions of another. So, if you or a loved one have been injured in an automobile accidents, call us today to learn more about what we can do for you.

Trucking Accidents

The number of large trucks – commonly referred to as semi-trucks or tractor-trailers – has increased over the years. It has been estimated that nearly 70% of all consumer goods are delivered by semi-trucks. These trucks typically stretch more than 70 feet and can weigh up to 80,000 pounds. Given the massive size of these vehicles, it is easy to see the serious danger they pose to other vehicles on the roadways. It’s also easy to understand how a (massive) truck can cause serious injuries or death when it is operated in a careless or negligent manner.

Both Federal and Florida laws regulate the operation of semi-trucks. These laws require strict compliance with regards to the number of hours a driver can operate a semi-truck, the gross weight of the truck, and many other factors that can cause or contribute to an accident. Failure to comply with these requirements can create additional liability on the part of a negligent driver and his employer. Moreover, with ever-changing technological advances in the transportation industry, trucks are now equipped with devices that can monitor and record critical information such as the speed of the truck. This information can be vital in a lawsuit against a trucking company. However, much of this information may legally be destroyed, or purged, after a very short period of time. Immediately hiring an attorney is an important step to assure that all essential evidence from your accident is properly preserved.

If you or a loved one has been injured by a large truck – semi-tractor trailer or otherwise – contact the attorneys at Caminez & Yeary to set up a free consultation to see we can protect your rights, preserve the relevant evidence, and get you the compensation you deserve.

Motorcyle Accidents

Motorcycle accidents are becoming all too common in Florida despite public awareness campaigns to “check twice”. The reason for this appears to be based on the fact that motorcycles are becoming a more popular, cost efficient way to commute, yet other drivers are not keeping a proper lookout. Whether the driver is distracted by a cell phone, screaming kids in the back seat or simply the daily stress that comes with life, other drivers are not observing motorcycles on the roadways and are causing accidents. Because motorcycles provide virtually no protection to the rider, these accidents commonly result in injuries that are catastrophic.

Those who survive a motorcycle accident are often left with large medical bills and the need for future medical services. Moreover, due to their injuries they are unable to work and may have lost their job. At Caminez & Yeary, we represent motorcyclists who have been injured due to someone else’s careless acts. We will fight with the insurance company to obtain the compensation you deserve. So if you or a loved one have been injured while riding a motorcycle, contact the attorneys at Caminez & Yeary today so that we can fight for you while you recover from your injuries.

Bus Accidents

If you have ever been a passenger on a bus – city, school, private charter, or otherwise – you can understand the potential for severe injuries arising out of a bus accident. Unlike a car, truck or SUV, buses do not have seat belts or airbags to help prevent injuries in the event of an accident. Therefore, bus accidents commonly result in injuries to the passengers on board.

As an injured passenger you have rights. Whether the accident was caused by the bus driver, a third party, or some mixture of both, you are entitled to compensation for the injuries and damages you sustain from the bus accident. However, navigating the legal minefield of suing the local government can become very complex. There are more stringent requirements which the injured party must comply with including stricter time limits and notice requirements. The attorneys at Caminez & Yeary successfully bring claims against the state and local governments on a regular basis have the experience necessary to get you the compensation you deserve. So, if you or a loved one has been injured in a bus accident, call the attorneys at Caminez & Yeary today to learn more about your rights.

Premises Liability

Premises liability is a legal theory which says that owners and/or occupiers of a premise have a legal duty to protect those individuals on their property from injuries caused by dangerous conditions that they know or should have known existed. Whether the dangerous condition be spilled water on the floor, a poorly lighted parking lot, an uneven step or an unstable chair, the owner of the property is the person in the best position to know about the dangerous condition and insure that it patrons are adequately protected from the dangers posed by the condition.

Cases involving injuries on another’s property are one of the leading causes of accidental injuries – second only to automobile accidents. As such, insurance companies dedicate time and money to fighting the wrongfully injured. At Caminez & Yeary, we have represented clients while injured at major stores including Walmart, Publix, Winn Dixie and many more. If you have been injured while on the premises of another, contact the attorneys at Caminez & Yeary today to find out how we can help you obtain the compensation you deserve.

Slip/Trip and Fall Accidents

Slip/Trip and Fall accidents are very common. They make up a large portion of the premises liability cases we handle at Caminez & Yeary. While some falls may cause no injury, other falls can result in surgery, paralysis or even death. These injuries can result in medical bills piling up, missed time from work, and also the inconvenience, pain and suffering you endure because of someone else’s negligent behavior.

Florida law applies various burdens upon the claimant when it comes to proving their slip/trip and fall case. For instance, if the dangerous condition is considered a transitory foreign substance – such as a banana peel or spilled water – the claimant has the burden to prove that the property owner had actual or constructive knowledge of the dangerous condition. A competent attorney can help guide you through the legal hurdles and develop your claim into one that the insurance company will have no choice but to pay.

It is because of these legal nuances that it is imperative that you meet with an attorney to determine your legal rights. Moreover, corporate retention policies can lead to the destruction of critical evidence in your case if the company is not instructed to preserve the evidence in a timely manner. So, if you or a loved one has been injured in a slip/trip and fall accident, call the attorneys at Caminez & Yeary today to see how we can help you obtain the compensation you deserve.

Dog Bite

Man’s best friend can turn into man’s worst enemy at any moment. While most dogs are harmless, they can cause serious injuries when they turn vicious. Under Florida Law, a dog owner is liable for injuries and damages caused to a person bitten by their dog. Whether the bite left a small scar or required extensive reconstruction surgery, you may be entitled to compensation.

If you have been the victim of a dog bite, contact the attorneys at Caminez & Yeary to learn more about your rights.

Defective Products

Defective products are one of the leading causes of personal injury. As a society, we are regularly hearing about products malfunctioning in the form of product recalls. This is typically of a sign that someone has been injured by a defective product. Upon receiving notice of the injury, the manufacturer goes into damage control mode by sending out a mass notice in the form of a recall. While recalls may prevent some injuries, they do not prevent all.

Defective products claims come in many shapes and sizes. They range from medical devices that malfunction to an unreasonably dangerous blender. They can arise from a defect in the product’s design, the manner in which it was manufactured, or the failure to provide an adequate warning. Some products liability cause very minor injuries while others can result in loss of limb or even death.

If you or a loved one has been injured by a product, you should immediately seek the guidance of an attorney. Often times there is important evidence that needs to be preserved in order to build a strong products liability case. Product manufacturers and distributors vigorously fight defective products cases, so it is critical that you build a strong case early on in the process.

At Caminez & Yeary, we are experienced in pursuing defective product cases on behalf of our clients. We have the experience necessary to fight the manufacturers and distributors on behalf of the injured to recover monetary damages for medical bills, lost wages, and inconvenience, pain and suffering. If you or loved one has been injured by a product, contact the attorneys at Caminez & Yeary to learn more about defective products cases and how we can help get you the compensation you deserve.

Medical Malpractice

We go to medical professionals when we are most vulnerable. We seek their expert care and advice to diagnosis, treat and cure medical issues we experience. However, medical professionals are human and they make mistakes. These mistakes can often times have serious consequences.

“Medical Malpractice” is a term used to describe the negligence, or mistake, of a medical professional such as a doctor, nurse or dentist. There is a prevailing standard of care that medical professionals are expected to (comply with). When a medical professional makes a mistake and causes a severe injury to the patient, their actions may fail to meet that standard of care that is expected. In cases such as this, the patient may have a claim against the doctor or nurse.

Although medical malpractice cases are founded on negligence, they are different than other negligence cases. The most striking difference is the pre-suit requirements. If you are involved in a car accident, you can walk into the courthouse and file suit against the negligent driver the next day. However, with medical negligence actions, there are stringent pre-suit requirements with which you must comply. Most notably, medical malpractice claims require that another medical professional from the same specialty provide an opinion that what the treating provider did, or did not do, fell below the prevailing standard of care. From there, there are notice requirements with which the injured party must comply. Navigating this process can become costly and burdensome.

At Caminez & Yeary, we strive to help those who have been wrongfully injured by a medical professional’s negligence. Contact us today to schedule a conference during which we can evaluate the case and determine whether you may have an action for medical malpractice.

Nursing Home Negligence

There comes a time in life when we realize that our loved ones need specialized care that we are not capable of providing. It is at this time that we place our family and their well-being in the hands of professionals. Nursing homes tend to provide outstanding care; however, like anything in life, there are times where the level of service our loved ones receive does not meet the basic standards that we have come to expect.

Nursing home negligence cases tend to be based on one or more of the following problems:

  • Negligent hiring
  • Inadequate training/supervision
  • Failing to have adequate staffing
  • Physical Abuse
  • Mental/Emotional Abuse
  • Medication Errors

If you or a loved one has been the victim of one of these problems, it is important to seek the advice of an attorney that can evaluate the situation and advise you regarding your rights. At Caminez & Yeary, we can advise you of your and your loved one’s rights.

Wrongful Death

The untimely death of a family member is one of the most difficult life experiences you may ever experience. Aside from the initial shock and emotional strain, there are often substantial financial burdens that arise from the death of a family member. In addition to the expense of laying the deceased to rest, families must also adapt to the lost support they received from the deceased – financially and emotionally. When accumulated over time, these losses are often substantial.

Although financial compensation may be the furthest thing from your mind when going through such a tragic experience, it is important that you seek counsel soon. Often times, there is critical evidence that needs to be preserved. Moreover, the time for bringing a wrong death action in Florida is much shorter than other claims. Speaking with an attorney sooner than later can ensure that the surviving family members receive the maximum compensation.

At Caminez & Yeary, we represent the families of individuals that have lost their life due to the acts of another. Whether the wrongful death arose out of a negligent act or intentional misconduct, family members of the deceased may be entitled to monetary damages. We understand that no amount of money will replace the loss you have suffered. We are here merely to guide you through the aftermath of this unfortunate incident and obtain you compensation to help ease the burdens you may experience moving forward in the future.

Our approach to representing accident victims is simple – we put your needs first. With attention and compassion we guide you through the personal injury claim process from start to finish. The insurance company will fight to keep from paying you a fair settlement. There are many ways they attempt to discredit you and attack your claim. We will help you avoid falling into these traps thereby maximizing the value of your claim.

WHY CHOOSE Caminez & Yeary?

There are plenty of options available when it comes to personal injury attorneys. The question becomes, “What sets Caminez & Yeary apart from the others?” The answer lies in our focus on putting the client’s interest before our own. Our primary mission is to help people. Many attorneys may say this, but when push comes to shove they seem to take the lion’s share of the settlement. Ask yourself – is this fair? At Caminez & Yeary, the client’s best interest will always come first.

Caminez & Yeary P.A. was originally founded in 1972 by attorney Jon Caminez. Mr. Caminez earned his law degree from the University of North Carolina. He began his legal career working for the United States Department of Justice. After gaining trial experience working for the Department of Justice Mr. Caminez entered private practice.

When Mr. Caminez first founded the firm it was headquartered in Tallahassee, Florida. Like many young lawyers beginning their own law practice, Mr. Caminez would accept any client that could walk in the door. This allowed him to practice in many different areas of law including criminal, business litigation and personal injury. It was during these early years that Mr. Caminez grew an affinity for representing injured people that needed help. As he would often say, he was “in the business of helping people.” By 1974 the practice’s focus was on personal injury law and the firm began to grow.

Mr. Caminez quickly grew a reputation for taking cases to trial when his clients were not offered a fair settlement. He took on large corporationsincluding the Buckeye Plant in Perry, Florida, Walmart, Lowe’s, and many other Fortune 500 companies. Despite gaining notoriety throughout north Florida for his success in the courtroom, he continued to put forth the same effort on every case – whether big or small – that he did when he first started. He understood that each case is important to the client involved and that he, as their attorney, should treat it that way.   This is a standard that the firm still adheres to today.

By the early 1980s Mr. Caminez was expanding his practice into the counties surrounding Tallahassee. It began with people in need of an attorney coming to his residence in Monticello, Florida, for legal advice. He decided to open an office in Monticello to better service clients in Jefferson, Madison and Taylor county. As the practice expanded in these areas, the firm’s headquarters migrated to Monticello.

The firm now operates two offices – one in Monticello and one in Tallahassee – allowing accident victims throughout the Big Bend easier access to legal representation. Over the years the practice has evolved from a one-man show to law firm with multiple attorneys working towards a common goal – helping injured people. Mr. Caminez has maintained a loyal staff over the years that includes attorney Scott Wolf and paralegal Shannon Brown. They combine for 35 years of experience of assisting personal injury victims. The firm has continued to evolve with the times and utilizes the latest technology in representing its clients.

Mr. Caminez first met Mr. Yeary while he was working for a Tallahassee firm representing insurance companies. The two individuals litigated many cases against one another over the years including one that ended in a jury trial. After gaining respect for each other and the manner in which they practiced law, Mr. Yeary was invited to join the firm in 2016. The addition brought something new to the law firm that it never had in its 44-year history – an insider’s view of how insurance companies evaluate and defend claims. This new insight allowed the firm to further enhance its representation of injury victims.

Mr. Caminez passed away in September 2016. He left behind a legacy of providing diligent legal representation to injury victims through hard work and focusing on the client’s needs, not those of the attorney. The current members of the firm work every day to continue the legacy left by Mr. Caminez.
